Bei automatisierten und autonomen Fahrzeugen wirkt sich die technische Verlagerung der Verantwortung für die Fahraufgabe vom Nutzer auf ein Steuerungssystem auf die strafrechtliche Verantwortung aus. Gerade für den Hersteller bergen strafrechtliche Konsequenzen das Potenzial einer innovationshemmenden Wirkung.
Ferdinand Hohenleitner studied law at the University of Passau. He completed his legal traineeship at the Higher Regional Court of Nuremberg, where he worked, among other things, for the public prosecutor's office and an international law firm in Munich. After passing the Second State Exam, he began working on his doctoral thesis. During this stage, he worked as a research assistant in the area of white collar crime for an international law firm and then as a lawyer in another international law firm in Munich. Most recently, the author worked for several years as a public prosecutor specialising in organised crime before returning to the private sector.
Es wird geklärt, ob die bestehende Strafrechtsdogmatik der rasanten technischen Entwicklung gerecht wird. In diesem Zuge kristallisiert der Autor einzelne Sorgfaltsanforderungen an Hersteller solcher Fahrzeuge heraus, geht auf den menschlichen Fahrer als Vergleichsmaßstab ein und widmet sich Fragen in Zusammenhang mit künstlicher Intelligenz. Es wird untersucht, wann es der Hersteller zu verantworten vermag, ein solches Fahrzeug in den Verkehr zu bringen, und welche Maßstäbe und Kriterien hierfür anzulegen sind. Der Autor zeigt, dass die technische Disruption keine grundlegenden Umwälzungen auf Ebene des Strafrechts erfordert. Es bedarf vielmehr der Adaption an die sich ändernde Lebenswirklichkeit.
